Terms of Service
Last updated: 17 October 2026
These terms are an agreement between you and Stampd Limited ("Stampd", "we", "us"), a New Zealand company. They apply when you use the Stampd app or the website stampd.co.nz. By creating an account or using Stampd, you agree to them. If you don't agree, please don't use Stampd.
The short version
- Stampd is a platform that connects businesses and their customers. We provide the digital stamp card. We don't sell coffee, haircuts or anything else, and we don't make the offers.
- Each reward and offer is made by the business, not by Stampd. If a business doesn't hand over a reward, changes its offer or closes, that's between you and the business.
- Like any app, Stampd may sometimes be unavailable. We're not responsible for stamps you couldn't collect while it was down.
- Businesses are responsible for their own offers, rewards and advertising.
- As far as the law allows, our responsibility to you is limited. For a business, the most Stampd will ever pay is the amount of your last monthly payment. Fees already paid aren't refunded.
1. What Stampd is
Stampd lets businesses run digital loyalty stamp cards, and lets customers collect stamps and rewards on their phone. Stampd is a platform only. We are not a party to any sale, offer or reward between a business and its customers, and we are not the agent of any business.
2. Your account
- Give accurate details when you sign up, and keep your password private. You're responsible for what happens on your account.
- Only use your own account. Businesses may share their business login with their own staff, but are responsible for how it's used.
- You can delete your account at any time in the app.
3. For customers
- Rewards are offered and provided by the business. Stampd doesn't guarantee that a business will honour a reward, keep the same offer, stay open, or stay on Stampd. Any question or complaint about a reward, product or service goes to the business.
- Stamps and rewards have no cash value, can't be exchanged for money, and can't be transferred or sold.
- Each business chooses its own rules — how many stamps a reward takes, how often you can collect a stamp, and whether cards expire. Those rules are shown in the app and can change.
- Don't try to collect stamps you didn't earn — for example by sharing or guessing PINs, or copying QR codes. We may remove stamps, rewards or accounts that were misused.
4. For businesses
- You are responsible for your own offers, rewards and promotions, including honouring every reward a customer earns, the accuracy of anything you advertise, and following New Zealand law (including the Fair Trading Act and Consumer Guarantees Act) in how you deal with your customers.
- You're responsible for keeping your staff PIN and login safe, and for any stamps given with them.
- Plans, prices and free trials are shown on stampd.co.nz. Payments are taken by Stripe, monthly in advance. If a plan isn't paid when a trial or paid period ends, stamping for your business may be paused until a plan is chosen. Customers' stamps are kept.
- Fees already paid are not refundable, including for months already passed or part-months after you cancel, except where the law requires a refund or as set out in section 6. You can cancel at any time; your plan keeps working until the end of the month you've paid for.
- You agree to cover Stampd for any claim, cost or loss that comes from your offers, rewards, promotions or dealings with your customers, or from you breaking these terms.
- You use Stampd for the purposes of your business. To the extent the law allows, the Consumer Guarantees Act does not apply to Stampd's services to you.
5. Availability
We work hard to keep Stampd running, but it's provided "as is" and "as available". Like any app or website, it may sometimes be slow, unavailable, or have errors — for example during maintenance, internet or phone problems, or problems with the companies that host it. We don't promise that Stampd will always be available or error-free, and we're not responsible for stamps or rewards that couldn't be collected while it wasn't working. We may change, add or remove features at any time.
6. Limiting our responsibility
As far as the law allows:
- Stampd is not responsible for the actions, offers, products, services, rewards or advertising of any business, or for any dispute between a business and a customer.
- Stampd is not liable for any indirect loss, such as lost profits, lost business, or lost stamps or rewards.
- If you're a business: Stampd's total liability to you, for any and all claims to do with Stampd, is limited to the amount of the most recent monthly payment Stampd received from you before the claim. You can't claim back earlier payments, or payments for months already passed, as compensation.
- If you're a customer: Stampd is free for customers, and Stampd's total liability to you for anything to do with Stampd is limited to NZ$100.
Your rights under New Zealand law: nothing in these terms takes away any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or the Privacy Act 2020 that can't legally be excluded.
7. Suspending or ending accounts
We may suspend or close an account that breaks these terms, is used to cheat or mislead, or puts other people at risk. You can stop using Stampd and delete your account at any time.
8. Your privacy
How we handle your information is explained in our Privacy Policy.
9. Changes to these terms
We may update these terms. If we make important changes, we'll update the date at the top and let you know in the app or by email. If you keep using Stampd after that, the new terms apply.
10. New Zealand law
These terms are governed by New Zealand law, and New Zealand courts deal with any dispute.
